Terms of Service
These terms govern your use of Assay. By creating an account or using the service, you agree to these terms.
1. Parties and service
These Terms are between you and the operator of Assay ("we", "us", "Assay"). Assay is a private chat companion that remembers who you are, your goals, preferences, and context across sessions — a place to think through the parts of your life you don't share with anyone else. Assay is not a clinician, therapist, lawyer, or financial adviser, and is not a substitute for professional help. The service is provided via our website and associated applications. We reserve the right to modify or discontinue the service with reasonable notice where possible.
2. Account and use
You must be at least 16 years old (or the minimum age in your jurisdiction to consent to these terms) to use Assay. You are responsible for keeping your account credentials secure and for all activity under your account.
You agree to use the service only for lawful purposes and in line with these terms. You must not use Assay to harass, abuse, or harm others; to distribute illegal, defamatory, or infringing content; or to attempt to gain unauthorised access to our or others' systems or data. We may suspend or terminate your account if we reasonably believe you have breached these terms.
3. Price and billing
Assay offers a Free tier and paid plans (Core and Max) at the prices shown on our pricing page, billed monthly in your local currency. The Free tier is continuously available and does not require a card. Paid plans are billed monthly from the date you subscribe. Prices and plans may change with notice; continued use after a change may constitute acceptance.
Payment is processed by Stripe. By subscribing to a paid plan, you agree to Stripe's terms and our billing policy. We do not store your full payment details; Stripe does. You can manage or cancel your subscription via Settings or the Stripe customer portal we make available.
4. Withdrawal and cancellation
If you are a consumer in the EU/EEA, you have a 14-day right of withdrawal from the distance contract (your paid subscription). If you withdraw within 14 days of the initial purchase, you are entitled to a refund for any amount paid for the service not yet consumed. To withdraw, contact us at [email protected] or cancel via the means we provide (e.g. Settings or Stripe portal) and request a refund within the 14-day period.
You may cancel your subscription at any time. Cancellation stops future charges; you retain access until the end of the current billing period. We do not provide refunds for partial periods except as required by law (e.g. withdrawal above) or at our discretion. To delete your account and all data, use Delete account in Settings → Account; see our Privacy Policy for how we handle your data after deletion.
5. AI, memories, and safety
Assay is an AI-driven service. The "memories" it stores are inferred from your conversations — they are structured summaries (e.g. preferences, goals, facts), not verbatim logs. We do not guarantee that the AI is accurate, complete, or suitable for any particular purpose. Assay is not a substitute for professional advice (e.g. legal, medical, financial). We do not use the system to make binding automated decisions with legal or similarly significant effects on you. We do not use your conversations or memories to train any AI model.
Assay is not a crisis service. If you indicate to Assay that you are in acute crisis or thinking about self-harm, our system may interrupt the normal conversation and direct you to emergency services and professional resources instead of generating a typical reply. In an actual emergency, contact local emergency services or a crisis hotline directly — do not rely on Assay.
6. Liability
To the extent permitted under applicable law (including Swedish law), we exclude liability for indirect, consequential, or incidental damages, and we limit our total liability to the amount you paid us in the 12 months before the claim. We do not guarantee uninterrupted or error-free service. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by law.
7. Termination
We may suspend or terminate your access to Assay if you breach these terms, or for operational or legal reasons, with notice where reasonable. You may stop using the service at any time and delete your account via Settings → Account. On termination, your right to use the service ends; we will handle your data as set out in our Privacy Policy (e.g. deletion within 30 days after you request account deletion).
8. Changes to these terms
We may update these Terms from time to time. We will post the updated version on this page and update the "Last updated" date. For material changes, we will notify you (e.g. by email or in-app notice). If you continue to use Assay after the change, you accept the new terms. If you do not agree, you must stop using the service and may delete your account.
9. Contact and governing law
For questions about these Terms or the service, contact us at [email protected].
These Terms are governed by the laws of Sweden. Any dispute shall be subject to the exclusive jurisdiction of the Swedish courts, unless mandatory consumer protection laws in your country give you the right to bring proceedings in your place of residence.
